You can not file against Money Gram unless you can prove that they defrauded you. You will have to file against the person that scammed you. Here in lies the problem. To serve a subpeona you will need a good name and address.

i wouldnt do it either tell the buyer that u r not comfortable with it. if he wants the phone it should be no prob. THe seller must always collect fund first and then ebay protects the buyer if it is never shipped.
